Street or Right-of-Way Vacation

Description: One or more property owners can request the Village to vacate a public right-of-way.

Reviewer(s): The Planning Commission makes a recommendation and the Village Board makes the final decision

Cash deposit: In addition to the application fee, the applicant must provide an initial cash deposit to cover the Village's review costs as set forth in a written pre-development agreement. Depending on the complexities involved, the applicant may need to deposit additional funds. Any funds remaining at the end, will be returned to the applicant.

Can a decision of the Village Board be appealed?

Yes; appeals are made to the circuit court and generally must be filed with the court soon after the decision has been made.

What is a cash deposit and why is one required?

For some types of development reviews, the Village requires an upfront payment that is used to pay for the time spent by the Village engineer, attorney, planner, or other professional in reviewing the application. In that way, Village taxpayers aren't paying for the cost of development activities. If costs exceed the initial amount, the applicant will need to deposit additional funds. Any money left in the deposit will be returned after the review has been completed.
